Welcome to ImageLoom AI! These Terms of Service ("Terms") govern your use of our website, services, and applications (collectively, the "Service"), provided by ImageLoom AI ("we," "us," or "our").
By creating an account or using our Service, you agree to be bound by these Terms.
1. Description of Service
ImageLoom AI is a generative art tool that allows users to upload two source images, which are then analyzed and synthesized by our proprietary AI pipeline to create a new, unique digital image (a "Fusion"). The Service operates on a credit-based system, managed through subscriptions and one-time purchases.
2. User Accounts
Account Creation: You must register for an account to access the Service. You agree to provide accurate and complete information.
Account Security: You are responsible for safeguarding your account login credentials. You must notify us immediately of any unauthorized use of your account.
Age Requirement: You must be at least 18 years old to use the Service.
3. Ownership and Content Rights
Your Inputs: You retain all ownership rights to the images you upload to the Service ("Input Images"). By uploading them, you represent and warrant that you have all necessary rights (including copyright and permissions) to do so and to allow us to process them as described in these Terms. You agree to indemnify us against any claims related to your Input Images infringing on third-party rights.
Your Fusions: You own the copyright to the unique images you create using the Service ("Fusions"). We grant you a perpetual, worldwide, non-exclusive, royalty-free license to use, reproduce, display, and create derivative works from your Fusions for any purpose, including commercial use, subject to your compliance with these Terms.
Our License to Your Content: To operate and provide the Service, you grant us a limited, non-exclusive, worldwide license to use, host, store, reproduce, and modify your Input Images and Fusions. This license is solely for the purpose of operating, securing, and improving the Service, and for providing the results back to you. We will never use your content for marketing or share it with other users without your explicit permission.
4. Credits, Subscriptions, and Payments
Credits: The Service requires "Credits" to generate Fusions. One (1) Credit is consumed for each successful Fusion generation request.
Subscriptions: We offer monthly subscription plans that grant a specific number of Credits each billing cycle. Unused subscription credits do not roll over to the next month unless otherwise specified.
Payments: All payments are processed through our third-party payment processor, Stripe. We do not store or have access to your credit card information.
Refunds: Subscription fees are billed in advance on a monthly basis and are non-refundable. Due to the computational cost of generating Fusions, all consumed Credits are non-refundable.
5. Acceptable Use
You agree not to use the Service to create, upload, or share any content that:
- Is illegal, harmful, hateful, infringing, or defamatory.
- Violates the privacy or rights of any third party.
- Attempts to reverse-engineer, decompile, or disrupt the Service.
- Generates content for the primary purpose of spamming or creating disinformation.
We reserve the right to suspend or terminate accounts that violate these rules.
6. Disclaimers and Limitation of Liability
The Service is provided on an "AS IS" and "AS AVAILABLE" basis.
Generative AI is a new technology. We make no warranties that the generated Fusions will be accurate, meet your specific requirements, or be free of errors or artifacts. The output may be unexpected.
Copyright & Training Data: Our service uses foundational AI models from third parties (e.g., Google's Imagen). While our process of synthesis is unique, we cannot guarantee that the output generated by these foundational models is completely free from any resemblance to existing copyrighted material. You are responsible for reviewing your Fusions for your specific use case.
To the fullest extent permitted by law, ImageLoom AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.
7. Termination
You may cancel your subscription and stop using the Service at any time. We reserve the right to suspend or terminate your account if you violate these Terms.
8. Changes to Terms
We may modify these Terms from time to time. We will notify you of any material changes. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
9. Governing Law
These Terms shall be governed by the laws of the State of Washington, United States, without regard to its conflict of law provisions.
